1) Improper Uses

TheSqueakyWheel Inc.'s Internet Services may only be used for lawful purposes. Transmission of any material in violation of any national, federal or state statute or regulation is prohibited. This includes, but is not limited to material legally judged to be threatening or obscene, compromise of copyrights, trade secrets, proprietary information and other intellectual property rights, libel or defamation of character, invasion of privacy, tortuous interference, and export of technical or military data to prohibited countries. The posting of copyrighted software without proper authorization (commonly referred to as Warez) and/or the posting of software access codes (commonly referred to as Cracks) will be cause for account cancellation with forfeiture of prepaid fees. You agree to indemnify and hold harmless TheSqueakyWheel Inc. from any claims resulting from your use of TheSqueakyWheel Inc.'s service. In addition the Customer will avoid violation of certain generally accepted guidelines on Internet usage such as mass mailings, mass advertisements, pirating or copying of software, mail bombing or other methods of attempting to deny service or access to other users, and attempts to violate security.

2) Pornography

Due to legal and social issues, we will not accept any new customers who publish pornographic images. We do not allow any pornographic content on our server, including but not limited to nude photographs, explicit language, or sexual fiction. If an existing customer publishes pornographic images, TheSqueakyWheel Inc. may suspend and/or cancel your account. Let's make this easy to understand: No site that promotes porn or nudity will be allowed on our servers, this includes BANNERS, CLICKER SITES, EDITORIALS, STORIES, NUDE PHOTOGRAPHS, EXPLICIT LANGUAGE, SEXUAL FICTION, OR ANYTHING THAT SOFT_ART DEEMS INAPPROPRIATE FOR OUR SERVERS. If an existing customer publishes pornographic images, TheSqueakyWheel Inc. will remove your site from our server and all monies paid will be forfeited. In addition the Customer is expected to use discretion in the treatment and handling of Internet information and data and to take particular care to insure that adult information is not transmitted to juvenile users of the Internet

3) Bulk E-mail, Spam, or Unsolicited E-mail Submission

NO DOMAIN MAINTAINED BY TheSqueakyWheel Inc. will be permitted to submit BULK E-MAIL of any type. This includes but not limited to using our E-mail server or any other BULK E-MAIL submission service, i.e. Cyber Promotions. This includes but is not limited to the use of the Domain Name or an E-mail Address for the Domain Name in the actual Bulk E-mail. If we receive a complaint on a BULK E-MAIL from a Domain maintained on our servers, the account will be subject to suspension and/or cancellation without notice. In addition the promotion or sale of bulk e-mail software or procedures is prohibited Commercial advertising is an accepted and welcome use of the Internet. However, there are appropriate and inappropriate places for Internet advertising. Unsolicited commercial advertisements are not allowed in e-mail, and will result in account suspension or cancellation. Commercial advertisements are unwelcome in most Usenet discussion groups and on most e-mail mailing lists. Inappropriate posting may result in account suspension or cancellation. See the newsgroup or mailing list's charter for whether advertising is allowed or not. "Spamming," or sending a message to many different off-topic newsgroups, is particularly unacceptable and will be treated as such. Sending a message, especially an advertisement, to more than five or six recipients, is by itself spamming unless the individuals have specifically requested to be added to a mailing list on that topic. E-mail is a person-to-person medium, not a broadcast medium. By the use of our Domain Maintenance Services (control panel), Uploading your files to our server(s) and/or the use of our E-mail services you hereby agree to the terms of our "Accepted Usage Policy" as well as the policies set forth on our Terms and Conditions page.

4) Limitation of Liability and Reliability

TheSqueakyWheel Inc.'s Internet Services are provided on an "as-is, as-available" basis, without warranty of any kind, expressed or implied, including, but not limited to, the warranties of performance, merchantability and fitness for a particular purpose. TheSqueakyWheel Inc. and/or contributors shall have no liability whatsoever to you for any claim(s) relating in any way to any lost profits or consequential, exemplary, incidental, indirect or special damages relating in whole or in part to your rights hereunder or use of, or inability to use, TheSqueakyWheel Inc.'s Internet Services. Under no circumstances and under no legal theory, tort, contract, or otherwise, shall TheSqueakyWheel Inc. or its suppliers or resellers be liable to you or any other person for any indirect, special, incidental, or consequential damages of any character including, without limitation, damages for loss of goodwill, work- stoppage, computer failure or malfunction, or any and all other commercial damages or losses.

4) Refunds, Exchanges and Cancellation policy

Web site hosting packages and web server co-location packages may be cancelled at any time by simply sending an e-mail to sales@TheSqueakyWheel.com or calling 416-252-0117. When the cancellation process has taken effect you will be sent an e-mail confirmation message. As soon as your hosting package is cancelled the site will be removed from our servers and no further charges will be posted to your credit card. Please note that there are no refunds given for partially unused time. For example, if you prepaid for 3 months of hosting and decided to cancel after the first month you would not receive a refund for the remaining 2 months.

Web site design orders may be cancelled at any time and no new bills will be issued. However, no refunds will be given for web design work that has already been completed or paid for, and any outstanding invoices must still be paid in full.

Complaints posted at TheSqueakyWheel.com - No refunds are given for complaints posted at TheSqueakyWheel.com. All sales are final.

Domain Name Registrations - No refunds are given for domains that have been registered. All sales are final.

Web site promotion packages may be cancelled at any time by simply sending an e-mail to sales@TheSqueakyWheel.com or calling 416-252-0117. Everything else

Cancellations are accepted at any time, however no refunds are given on deposits or pre-paid services.

5) Privacy policy

All billing information collected by TheSqueakyWheel Inc. will be kept confidential within our organization. We never sell or give away personal or aggragate information collected from our customers to outside companies.
